Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on December 22 and <br /> December 29, 2000, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> �d <br /> Wednesday, January 10, 2001, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Edward M. Govoni,Robert G.Nelson <br /> ` and Frederick R. Borgeson. <br /> zil <br /> �t. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. David Sanicki of Cape &Islands Engineering represented the Petition. On <br /> March 22, 2000, the Board granted a Variance(V-00-90)from the front setback <br /> requirements to allow for construction of a home on the subject property. A slight <br /> change was made when the foundation was poured. <br /> x <br /> Attorney Thomas Souza represented Dr. Kroll, an abutter, who expressed concern <br /> with the location of the proposal to his home. The proposed construction would be <br /> further away from Dr. Kroll's property line and further away from the coastal bank than <br /> L�t <br /> .
