Cohrs SP-01-8 2 <br /> Board of Appeals <br /> A <br /> SPECIAL PERMIT CRITERIA <br /> fB <br /> Section 174-17 of the Mashpee Zoning By-laws and Massachusetts General <br /> E Laws Chapter 40A, Chapter 6,require a finding that the extension, alteration or change <br /> shall not be substantially more detrimental to the neighborhood than the existing <br /> non-conforming use. <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 21 Bayview Road and consists of over <br /> r ` 12,000 square feet of land. <br /> r SPECIFIC FINDINGS <br /> u. <br /> The Board determined that: <br /> F <br /> C 1. due to the long, sloping narrow topography and shape of the lot,there is no <br /> won"" <br /> other location for the proposed construction. <br /> 2. the proposed construction does not conform to the side setback requirements <br /> and the Board has granted a Variance. <br /> 4 3. there is adequate land area to provide sufficient parking. <br /> 4. the immediate neighborhood consists of single-family homes of similar size; <br /> f many of which have been improved with additions or reconstruction. <br /> } In view of the foregoing,the Mashpee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the granting of a Special Permit. Upon motion <br /> duly made and seconded,the Zoning Board of Appeals voted unanimously on January <br /> 10, 2001 to grant a Special Permit to allow for demolition of the existing dwelling on the <br /> subject property. The Special Permit is conditioned upon compliance with the following: <br /> 1. Cape &Islands Engineering plan entitled: "Proposed Site Plan Located in <br /> Mashpee,Mass., Prepared for Stephen Cohrs, Date: Dec. 8, 2000". <br /> 2. SPB Design plan entitled: "First& Second Floor Plans/Notes, Cohrs <br /> Residence,Mashpee,MA.,Plan Date: 12/1/00". <br /> ,uJ } <br /> 3f <br />
