McLatchy, Jr. SP-01-10 63 Riverside Road <br /> Map 120 Block 1 <br /> A Petition was filed on December 8, 2000 by William H. and Helen L. McLatchy, <br /> Jr. of Mashpee, Massachusetts for a Special Permit under Section 174-17 of the Zoning <br /> By-laws to allow for removal of a block foundation and installation of a poured concrete <br /> foundation within the same footprint to a pre-existing,non-conforming home on property <br /> located in an R-3 zoning district at 63 Riverside Road(Map 120 Block 1)Mashpee,MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on December 22 and <br /> December 29, 2000, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, January 10, 2001, at which time the following members of the Zoning Board <br /> P <br /> of Appeals were present and acting throughout: Edward M. Govoni, James E. Regan III <br /> and Robert G.Nelson. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. David Sanicki of Cape &Islands Engineering represented the Petition and <br /> stated that the builder suggested a several-foot high, non-inhabitable space beneath the <br /> dwelling. The Decision for a Special Permit, SP-00-185, limited the proposed elevation. <br /> The Petitioner is requesting that the Decision should reflect that the proposed installation <br /> of the new foundation shall be in accordance with flood hazard requirements and height <br /> restrictions of the Zoning By-laws. The Petitioner does not plan to make any changes to <br /> the existing cottage. <br /> No comments were received from abutters. <br /> K ja_ <br />
