SP-01-6 Map 105 Block 234 <br /> 138 Waterway <br /> sa <br /> u� <br /> _ A Petition was filed on December 19, 2000 by Chilton Development Company, <br /> �r <br /> 1 <br /> Inc. of Marshfield, Massachusetts for a Special Permit under Sections 174-17 and 174-20 <br /> of the Zoning By-laws for permission to demolish an existing dwelling and construct a <br /> 't= single-family home on property located in an R-3 zoning district at 138 Waterway <br /> a <br /> (Map 105 Block 234)Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on December 22 and <br /> December 29, 2000, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, February 28, 2001, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: James E. Regan III, Richard T. <br /> Guerrera and Frederick R. Borgeson. This Petition has been continued from the January <br /> 10 and January 24, 2001 Public Hearings to allow the Petitioner an opportunity to receive <br /> Conservation Commission approval. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Michael Grotzke of The Phoenix Group represented the Petition and stated <br /> that plans call for demolition of the existing structure and construction of a new home on <br /> the subject property. <br /> The Conservation Commission has requested that the Petitioner maintain the 50' <br /> setback from water and wetlands. The Conservation Commission has approved the <br /> proposal. <br /> The Board discovered that the Petitioner needs a Variance from the Zoning <br /> By-laws to exceed the lot coverage requirements to allow for the proposal. <br />
