" Mashpee Zoning Minutes—January 24, 2001 5 Board of Appeals Mr.Nelson moved to grant a Variance of 599 square feet from the land space requirements, subject to the following: • obtaining an easement,minimum of 6x6 feet, across Lot#32 on the Assessor's map to allow for access to the open space. • findings: due to the Town's error, the subject lot was considered buildable without a Special Permit. • the proposal does not need any Variances from the setback requirements. • lots could be 10,000 square feet in a cluster subdivision. Mr. Guerrera seconded. All agreed. Kathleen M. & James K. Miller—Request a Variance from Sections 174-59 and 174-63 of the Zoning By-laws to allow for installation of utilities in a basement lower than the base flood elevations and installation of interior stairs from the basement to the first floor of an existing dwelling on property located in an R-3 zoning district at 105 Popponesset Island Road(Map 112 Block 29) Mashpee, MA. Continued from October 11 and December 13, 2000 Public Hearings to allow Building Department to contact FEMA/state engineer. The Board received a Request for Withdrawal Without Prejudice of the above-referenced Variance,V-00-188. Mr. Nelson moved to accept the Request. Mr. Brem seconded. All agreed. Frederick R. & Lois S. Glass—Request an Appeal of the Building Commissioner's Decision to Deny a Building Permit on property located in an R-3 zoning district at 133 Tide Run(Map 120 Block 180)Mashpee, MA. Continued from December 13, 2000 Public Hearings at attorney's request to allow for resolution with Building Department. Attorney Kevin M. Kirrane requested a Continuance/Extension of the Appeal. The Board voted unanimously to continue/extend the Petition until the end of February 2001. MINUTES Mr.Nelson moved to accept the Minutes of January 10, 2001. Mr. Regan seconded. All agreed.
