Mashpee Zoning Minutes—February 14, 2001 5 <br /> Board of Appeals <br /> Ms. Dulce Bryan, an abutter, said that she attended the Cape Cod Commission' meeting <br /> in October or November of last year. She asked for a copy of the Decision. Ms. Bryan ! <br /> said that the proposal would be "ruining your two-acre zoning" and"crowds your schools <br /> and crowds your roads" and that it "destroys the whole intent of zoning". She currently <br /> has her abutting property for sale. <br /> Mr. Paul Avrett, an abutter, agreed with Ms. Bryan's comments. He said that there is <br /> already a lot of traffic in the area and that constructing 28 more homes in the area would <br /> only add to the congestion. j <br /> Mr. Wheeler said that in order to develop the cluster subdivision and reduce the j <br /> minimum required size of the lots,the Petitioner would donate open space to the Town. <br /> Mr. Hersey said that this subdivision is grandfathered and is not subject to the two-acre <br /> zoning requirement. <br /> Ms. Shirley Nurse Peters, an abutter, also objected to the proposal. She questioned if the j <br /> Petitioner was unaware of the Growth Management By-law when he petitioned the Cape <br /> Cod Commission with the proposal. She said that the Petitioner should have done his <br /> homework prior to his Petition and should not now be asking for relief due to financial <br /> hardship. Ms. Peters said that the threat of constructing 132 affordable housing units <br /> versus constructing 28 homes is like putting a"gun to your head". <br /> Mr. Guerrera said that he would be in favor of continuing the Petition in order to peruse <br /> the Cape Cod Commission Decision. The other Board members agreed and stated that <br /> the proposal would have a big impact on the Town and that they would need more time <br /> before rendering a decision. Ms. Elizenberry asked for a copy of the traffic study. <br /> Mr. Cronin said that he would make sure that the Board received copies of all relevant <br /> material. <br /> i' <br /> Mr. Avrett questioned the proposed septic system. Mr. Hersey said that Title V <br /> denitrification septic systems would be installed. Mr. Regan said that the Board of Health <br /> would be able to provide the abutters more information on the proposed septic systems. <br /> ,I <br /> Mr. Regan suggested to the abutters that they keep in mind that many cluster subdivisions <br /> exist in Town that are significantly more dense than the proposed Lowell Road <br /> subdivision. He recommended that the abutters drive through the Quashnet Valley and <br /> Seabrook Village neighborhoods. <br /> Mr. Cronin said that the Petitioner has to install several monitoring wells to check the <br /> nitrogen loading percentages. He also said that the cluster zoning would create open <br /> space in the rear of the property. <br /> Mr. Borgeson moved to continue the Petition until March 28, 2001. Mr. Guerrera <br /> seconded. All agreed. The Board also made plans to conduct an on-site visit. <br />
