Marotta V-01-21 159 Falmouth Sandwich Road <br /> Map 41 Block 85 <br /> A Petition was filed on January 19, 2001 by Vito C. Marotta of Mashpee, <br /> Massachusetts for a Variance from Section 174-26.A of the Growth Management Zoning j <br /> By-laws for permission to construct a single-family home in a three-lot subdivision on <br /> property located in an R-5 zoning district at 159 Falmouth Sandwich Road(Map 41 i <br /> r Block 85)Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General I� j <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on January 26 and <br /> February 2, 2001, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, February 14, 2001, at which time the following members of the Zoning i <br /> Board of Appeals were present and acting throughout: James E. Regan III, Frederick R. <br /> Borgeson and Zella E.Elizenberry. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> i' <br /> Mr. Marotta represented his Petition and stated that he plans to construct a <br /> single-family home on land that he purchased in May 1999 and subsequently subdivided <br /> in March 2000. Mr. Marotta said that the subject lot consists of 3.4 acres and that <br /> i <br /> construction of the proposed 6-bedroom home would comprise less than I% lot coverage. <br /> Mr. and Mrs. Peter Birdsey, abutters, attended the meeting and expressed I <br /> approval of the project. No other comments were received from abutters. <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 159 Falmouth Sandwich Road and <br /> consists of 3.4 acres of land. <br />
