SP-01-27 128 Waterway <br /> Map 105 Block 232 <br /> A Petition was filed on February 6, 2001 by Chilton Development Company, j <br /> Inc. of Marshfield, Massachusetts for a Special Permit under Section 174-25.I.9 of the <br /> ii <br /> Zoning By-laws for permission to modify and maintain an existing pier,ramp and float <br /> on Popponesset Creek on property located in an R-3 zoning district at 128 Waterway <br /> (Map 105 Block 232) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on February 9 and <br /> February 16, 2001, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, February 28, 2001, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: James E. Regan III, Richard T. <br /> Guerrera and Frederick R. Borgeson. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Michael Grotzke from The Phoenix Group represented the Petition and stated <br /> that plans call for modification of the existing structure by extending the dock.. The total <br /> length will be under the allowed 70-foot length limit. <br /> The Department of Environmental Protection issued License Plan No. 5398 (DEP <br /> File No. SE 43-2017) in 1996 to allow for construction of the pier, ramp and float on the <br /> subject property. That plan was recorded at the Barnstable County Registry of Deeds on <br /> April 23, 1996, DOC#: 663,624. <br /> Mr. Grotzke stated that the Conservation Commission,Harbormaster and <br /> Shellfish Constable have approved the proposal. <br /> No comments were received from abutters. <br />
