Owner <br /> of record: Henry C. Labute, Trustee. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on February 9 and <br /> February 16, 2001, a copy of which is attached hereto and made a part hereof. <br /> ; I <br /> A Public Hearing was held on the Petitions at the Mashpee Town Hall on <br /> Wednesday, February 28, 2001, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: James E. Regan III, Zella E. <br /> Elizenberry and Frederick R. Borgeson. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A Sections 9 and 10 and the Town <br /> of Mashpee Zoning By-laws. <br /> Attorney Thomas Souza represented the Petitions and stated that he does not have <br /> site plans of the proposal. <br /> i <br /> Mr. Regan said that it was illogical that the Petitions were filed with the Zoning <br /> Board of Appeals before being filed with the Design Review and Technical Review <br /> Committees. He said that Counsel is appearing before the Board without the necessary <br /> information for either the Board to render a decision or for the abutters to obtain pertinent <br /> information. <br />
