A
2. Height B
Mr. Glass filed site and architectural plans with the Zoning Board of Appeals. The
architectural plans show a building 35 feet in height.
However, the site plans indicate that the top of the foundation will be at elevation 12.5,
obviously to get the height of the structure above the 100-year flood elevation which j
covers the entire lot. Existing grade is at elevation 8. The total height of the structure,
therefore, above existing grade, will be 39.5 feet, a violation of the zoning by-law.
Thus, an additional variance is required for the height of the structure approved by the
Board of Appeals on April 28, 1999.
Because these variances have not been sought or obtained, Mr. Glass does not have the
requesite zoning relief to obtain a building permit for the structure approved by the
Zoning Board of Appeals on April 28, 1999.
I ask that you so rule, and that you enforce the Zoning by-law by refusing any building or
foundation permit to Mr. Glass or his agents until the Zoning Board of Appeals has
granted this relief.
I agree with the foregoing and so rule:
Dated: September 2000
William Hauck
Building Inspector,Town of Mashpee
I do not agree with the foregoing and so rule:
j
Dated: September 2000
William Hauck
Building Inspector,Town of Mashpee
I
