`town of Mashpee <br /> MASHPEE ZONING BOARD OF APPEALS 16 Great Neck Poad Xorth <br /> AHIE Mashpee,Massachusetts 02649 B <br /> Decision for Denial Without Prejudice <br /> r <br /> RE: PAL Trust V-01-26 Map 114 Block 23A <br /> 157 Monomoscoy Road <br /> A Petition was filed on February 5, 2001 by PAL Trust of North Falmouth, <br /> Massachusetts for a Variance from Section 174-31.4 of the Zoning By-laws for <br /> permission to use the proposed new finish grade elevation combined with the existing <br /> grade elevation to allow for construction of a single-family home on property located in <br /> an R-3 zoning district at 157 Monomoscoy Road(Map 114 Block 23A)Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on February 23 and March 2, <br /> 2001, a copy of which is attached hereto and made apart hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, March 14, 2001, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Edward M. Govoni, Richard T. Guerrera <br /> and Frederick R. Borgeson. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> ! I <br /> Mr. Paul Lalito, owner of LEC Environmental, represented the Petition. Terry <br /> Luff, architect for the project, and Ralph A. Cook, owner of the subject property, also <br /> attended the meeting. <br /> Because placement of the septic system had to be elevated from the original <br /> grade the Petitioner er is requesting stm a height <br /> Variance to allow for construction of the <br /> single-family home. Mr. Lalito said that a very small portion of the house, approximately <br /> 5%of the roofline, exceeds the 35-foot height restriction. Mr. Luff said that the extra <br /> room on the third floor would be a lookout room. <br /> I <br /> Members of the Board remarked that the proposal calls for a three-story <br /> construction and that the lookout room is not an essentialart of the proposal.osal. <br /> p <br />
