Owner of <br /> record: Duck Pond Limited Partnership. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on November 3 and <br /> November 10, 2000, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, <br /> February 28, 2001, at which time the following members of the Zoning Board of Appeals <br /> were present and acting throughout: James E. Regan III, Richard T. Guerrera and <br /> Frederick R. Borgeson. The Petitioner requested a continuance from the November 22, <br /> 2000 and January 10, 2001 Public Hearings and an extension of the time for the Board to <br /> render a Decision in an effort to resolve Town Zoning By-laws' violations. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> At the Public Hearings on February 28, 2001, Building Commissioner Russell W. <br /> Wheeler stated that the Mattress &Furniture Place has recently ceased business and <br /> moved out of the subject location. He also said that the Zoning By-laws' violations have <br /> not been resolved. <br /> No one attended the meeting on behalf of the Petitioner. No comments were <br /> received from abutters. <br /> On February 28, 2001,the Zoning Board of Appeals voted unanimously to Deny <br /> Without Prejudice the above-referenced Petition, SP-00-204. <br /> i <br /> i <br />
