Owner of record: Duck Pond Limited Partnership. <br /> 'II <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on September 15 and <br /> September 22, 2000, a copy of which is attached hereto and made a part hereof <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> October 4, 2000, December 13, 2000 and February 28, 2001, at which time the <br /> following members of the Zoning Board of Appeals were present and acting <br /> throughout: James E. Regan III, Richard T. Guerrera and Frederick R. Borgeson. <br /> The Petitioner requested the continuances and an extension of the time for the Board <br /> to render a Decision in an effort to resolve Town Zoning By-laws' violations. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 9 and the Town <br /> of Mashpee Zoning By-laws. <br /> Ms. Marjorie Burgess, business manager, represented the Petition and said <br /> that the owner, Mark Clark, is requesting permission to locate a 45-foot trailer behind <br /> the loading dock for storage of used mattresses. The used mattresses would be disposed <br /> of on a weekly basis. <br /> At the Public Hearings on February 28, 2001, Building Commissioner Russell W. <br /> Wheeler stated that the Mattress & Furniture Place has recently ceased business and <br /> moved out of the subject location. He also said that the Zoning By-laws' violations have <br /> not been resolved. <br /> No one attended the meeting on behalf of the Petitioner. No comments were <br /> received from abutters. I <br /> On February 28, 2001,the Zoning Board of Appeals voted unanimously to Deny <br /> Without Prejudice the above-referenced Petition, SP-00-169. <br /> I <br /> f <br /> i <br /> C <br />
