V-01-34 138 Waterway <br /> Map 105 Block 234 <br /> A Petition was filed on March 7, 2001 by Chilton Development Company, Inc. <br /> of Marshfield, Massachusetts for a Variance <br /> from <br /> Section 174-31 74 31 of the Z - <br /> Zoning By-laws <br /> Y <br /> for permission to vary the lot coverage requirements to allow for construction of a <br /> single-family home on property located in an R-3 zoning district at 138 Waterway <br /> (Map 105 Block 234)Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General :I <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper ofeneral circulation in the <br /> g Town of Mashpee, on March 9 and March 16, <br /> 2001, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, March 28, 2001, at which time the following members of the Zoning Board <br /> I <br /> of Appeals were present and acting throughout: James E. Regan III, Frederick R. <br /> Borgeson and Marshall A. Brem. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Michael Grotzke of the Phoenix Group represented the Petition. On February <br /> 28,2001,the Zoning Board of Appeals granted a Special Permit to allow for demolition <br /> t <br /> of an existing dwelling on the subject property. The Petitioner is now requesting a l <br /> Variance from the lot coverage requirements to allow for construction of asingle-family <br /> jI <br /> home on the property. <br /> No comments were received from abutters. <br /> VARIANCE CRITERIA <br /> Section 10 of Chapter 40A requires s that the permit granting au <br /> thority determine <br /> that there are circumstances relating to the shape and topography which affect this lot and <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve <br /> hardship to the petitioner. <br />
