Mashpee Zoning Minutes—May 9,2001 5 <br /> Board of Appeals <br /> Mr. Borgeson moved to Deny With Prejudice the Appeal of the Building Commissioner's <br /> Decision to issue a Building Permit. Mr. Govoni seconded. All agreed. j <br /> George M. Locarno. Trustee—Requests a Special Permit under Section 174-25.A.8 of <br /> the Zoning By-laws to allow for conversion of an existing dwelling to accommodate not <br /> more than two families on property located in an R-3 zoning district at 51 Waterline j <br /> Drive South(Map 120 Block 145)Mashpee, MA. <br /> Sitting: Edward M. Govoni, Richard T. Guerrera and Zella E. Elizenberry. <br /> Mr. Locarno did not attend the meeting. Plans and/or photos were never submitted to the <br /> Board or to the Town Clerk for public record.Mr. Locarno informed the ZBA office that <br /> he was not going to attend the meeting and that he did not care what the Board did <br /> because he has an occupancy permit. <br /> Mr. Govoni read a letter from the Little Neck Bay Association in opposition to the <br /> proposal because "this request is not permitted under the Village Declaration". The <br /> Board also received a fax from Mr. George Darcy, an abutter at 57 Waterline Drive <br /> South, in opposition to the proposal. <br /> Mr. Cramer, a neighbor; said that he was under the impression that homeowners in Little j <br /> Neck Bay were not permitted to have more than one kitchen or an in-law apartment. <br /> Mr. Govoni agreed and moved to Deny With Prejudice the Petition for a Special Permit. <br /> Ms.Elizenberry seconded. All agreed. The Board informed Mr. Cramer that the <br /> Building Commissioner would be informed of the Board's decision and is responsible as <br /> the Zoning Enforcement Officer to ensure that Mr. Locarno is in compliance with the <br /> By-laws. <br /> Michael D. &Amy T. Crowe-Request a Special Permit under Section 174-25.A.8 f <br /> of the Zoning By-laws to allow for an in-law apartment in an existing home on property <br /> located in an R-3 zoning district at 75 Cayuga Avenue(Map 58 Block 13)Mashpee,MA. <br /> Sitting: Zella E. Elizenberry, Frederick R. Borgeson and Marshall A. Brem. Mr. Regan <br /> stepped down and left the room. <br /> I <br /> Mr. Michael Crowe represented his Petition and submitted photos of his home. Section <br /> 174-25.A.8 reads "Conversion of an existing dwelling to accommodate not more than <br /> two families,provided that there is not external evidence of occupancy by more than one <br /> family and further provided that each dwelling <br /> unit resulting from such conversion shall <br /> have not less than seven hundred fifty square feet of habitable floor space". The photos <br /> and house plans indicate that the Petitioner meets the qualifications.
