On or about February 27, 2001, the Building <br /> Commissioner for the Town of Mashpee issued a building permit to <br /> Mr. and Mrs . Glass to construct a residential dwelling at the <br /> Premises. <br /> 5. Plaintiffs appealed the issuance of that building <br /> i , <br /> permit to the ZBA, which held a hearing on plaintiffs' appeal on � ! <br /> May 9, 2001 . <br /> 6. On May 9, 2001, the ZBA voted to affirm the decision of <br /> the Building Commissioner. A certified copy of the ZBA' s ' I <br /> decision, as filed with the Town Clerk, is attached hereto as <br /> i -- <br /> Exhibit A. <br /> 7. The decision of the ZBA in affirming the issuance of I .' . <br /> the building permit exceeds the authority of the ZBA and is <br /> arbitrary and capricious. <br /> 8.
