Attorney Roberts said that the first <br /> Appeal was technically incorrect. Now that the building permit has been issued, this <br /> Appeal is against the actual issuance of the building permit. <br /> Attorney Kevin M. Kirrane represented Mr. and Mrs. Frederick R. Glass, owners <br /> of 133 Tide Run. Attorney Kirrane agreed that the Petitioner's previous counsel was in <br /> error to Appeal the Building Commissioner's letter and that litigation should not have 4 <br /> been filed against the Zoning Board of Appeals based on that filing. Attorney Kirrane j <br /> said that the actual issuance of the building permit is an act of the Building <br /> I <br /> ommissioner, that the e Building Commissioner was right in issuing the building permit f <br /> i <br /> and asked the Board to uphold his Decision. <br /> The Zoning Board of Appeals determined that the Petitioner failed to provide any <br /> new evidence or any evidence that the Building Permit issued for 133 Tide Run was in <br /> violation of Zoning By-laws. <br /> In view of the foregoing,the Zoning Board of Appeals voted unanimously on <br /> May 9, 2001 to Deny With Prejudice the Appeal of the Building Commissioner's <br /> i <br /> Decision to issue a Building Permit to 133 Tide Run. <br /> i <br /> i <br /> f <br /> i <br />
