Notice was given by publication in The Mashpee Enterprise,
a newspaper of general circulation in the Town of Mashpee, on April 20 and
April 27, 2001, a copy of which is attached hereto and made a part hereof. i
A Public Hearing was held on the Petition at the Mashpee Town Hall on
Wednesday, May 9, 2001, at which time the following members of the Zoning Board of
Appeals were present and acting throughout: Edward M. Govoni, James E.Regan III and
Frederick R. Borgeson.
The Mashpee Zoning Board of Appeals issues this Decision pursuant to the
provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of
Mashpee Zoning By-laws.
Attorney Kevin M. Kirrane represented the Petition and stated that the subject
parcels are shown on a 1913 Plan and predate adoption of Zoning in Mashpee. A number
of the lots have been held in common ownership and have been deemed merged for
zoning purposes.
Attorney Kirrane submitted elevation and house plans of the proposed
construction. He stated that the hardship exists because of the 40-foot front setback
requirement and the 50-foot setback requirement from water and wetlands.
Mr. and Mrs. St. Pierre also attended the meeting.
III; '
I'
jI I ',
