Mashpee Zoning 3 <br /> Board of Appeals <br /> Roderick St. Pierre V-01-53 I' <br /> 2. because of the wetland setback requirement of 50 feet and the front setback <br /> requirement of 40 feet, a literal enforcement of the By-laws would involve <br /> hardship to the Petitioner. I <br /> 3. without relief the lot could not be used for a residence,the purpose for which <br /> it had been laid out and for which the balance of the undersized lots in the <br /> subdivision were being used. I <br /> 4. the lot has been maintained as buildable and taxable on the Assessor's <br /> Records and is subject to betterments from the Water District. <br /> 5. the proposal would be an improvement to the subject property and to the <br /> neighborhood. <br /> 6. because the Board of Health has approved installation of a septic system <br /> developed d to ensure minimal impacts on theadjacent environ <br /> mentally <br /> sensitive areas, relief may be granted without detriment to the public good or <br /> to the neighborhood. <br /> 7. the Conservation Commission has approved the proposal. <br /> 8. the Building Commissioner has expressed approval of a 10-foot front setback. <br /> In view of the foregoing,the Mashpee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the granting of a Variance. Upon motion duly <br /> made and seconded,the Zoning Board of Appeals voted unanimously on May 9, 2001 to <br /> grant the following: <br /> L 14.6 feet from the border of vegetated wetlands. <br /> i <br /> 2. 30 feet from the current front setback requirements. <br /> 3. 27,865 square feet from the land space requirements. (calculation is based on <br /> the exclusion of the wetlands area from the total square footage of the lot). <br /> The Variance is conditioned upon compliance with BSC Group plan entitled I <br /> "Sewage Disposal System Design, 261, 265-269 Monomoscoy Road,Mashpee,MA, f <br /> Assessors Map 120 Lots 40, 41 &42, Prepared for: Roderick St.Pierre,Date: December <br /> 13, 2000, File No. 5880sep.DWG". <br /> I! <br />
