Blythe SP-01-60 228 Wading Place Road <br /> Map 112 Block 59 <br /> A Petition was filed on April 26, 2001 by Frederic W. Blythe of Mashpee, <br /> Massachusetts for a Special Permit under Section 174-25.I.9 of the Zoning By-laws for <br /> permission to construct a pier, ramp and float on Popponesset Creek on property located <br /> in an R-3 zoning district at 228 Wading Place Road (Map 112 Block 59)Mashpee, MA. <br /> I�Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on May 4 and May 11, 2001, <br /> a copy of which is attached hereto and made a part.hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesdav, May 23, 2001, at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: Robert G. Nelson, Zella E. Elizenberry and � <br /> Marshall A. Brem. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of 1_`v' assachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Attorney Paul C. Wightman and Engineer Dave Reall represented the Petition. <br /> Mr. Blythe also attended the meeting. Attorney Wightman informed the Board that, after <br /> many years in litigation, a resolution has been reached. The Agreement for Judgment <br /> calls for relocation of the dock and for the dock to be a shared facility with an abutter, <br /> Mr. Siegfried. The proposal would be under the 150 square-foot size limit and the floats <br /> would be removed seasonally. { <br /> i <br /> Mr. Christe Kondochriste, a neighbor, reviewed the plans and expressed concern <br /> that the proposal v\,ould interfere with his mooring. Mr. Reall said that the proposed <br /> construction would be approximately 4101 feet fron.� Mr. Kondochriste's mooring. _ <br /> Ms. Carolyn Anderson asked how many boats would be moored at the proposed <br /> dock. Attorney Wightman indicated that only two boats would be allowed and that the <br /> Agreement for Judgment also places restrictions regarding the size and type of boat that <br /> would be allowed. j <br /> i <br /> Mr. Caffyn referred to the letter sent to the Board by Ms. Nancy Caffyn, an <br /> abutter, in opposition to the proposal. He said that he and his mother have major <br /> concerns about the safety of children playing in the area. <br /> i <br /> i' <br />
