BLYTHE ) � <br /> ) <br /> i <br /> i <br /> AGREEMENT FOR JUDGMENT <br /> WHEREAS, the parties have reached a settlement in the <br /> above-entitled; and <br /> WHEREAS, Entry for Dismissal Nisi was entered by this court <br /> on March 2, 2001; <br /> THEREFORE,. the parties enter into the following Agreement <br /> for Judgment : <br /> 1 . The Special Permit issued to the Defendant, Frederick <br /> W. Blythe, by the Mashpee Board of Appeals, Permit No. 97-60, j <br /> will be for a shared facility, and the Plaintiffs, Edward R. and <br /> Margo M. Siegfried, their heirs, assigns and successors in I{ <br /> interest, shall have deeded rights to use the dock in accordance <br /> with the permit issued. <br /> 2 . Mr. Blythe will bear the costs of constructing the - -- <br /> dock. <br /> t <br /> 3 . Boats moored at the dock will be no longer than 27' j <br /> unless the parties, their heirs, successors, or assigns agree <br /> otherwise. Boats with outboard engines will be permitted at the <br /> dock. All boats moored at the dock with inboard engines shall 1 <br /> exhaust underwater. No "cigarette" boats will be permitted to <br /> moor at the dock. <br /> Page 1 <br />
