Board Members present <br /> were Chairman Edward M. Govoni, Clerk Robert G. Nelson and Associate Members <br /> Richard T. Guerrera, Zella E. Elizenberry, and Marshall A. Brem. Building <br /> Commissioner Russell W. Wheeler also attended the meeting. Vice Chairman James E. <br /> Regan III and Frederick R. Borgeson were not present. <br /> CONTINUED HEARINGS <br /> Frederic W. Blythe—Requests a Special Permit under Section 174-25.I.9 of the Zoning <br /> By-laws for permission to construct a pier, ramp and float on Popponesset Creek on <br /> property located in an R-3 zoning district at 228 Wading Place Road (Map 112 Block 59) <br /> Mashpee,.MA. <br /> 1�• <br /> Sitting: Marshall A. Brem, Richard T. Guerrera and Robert G. Nelson. <br /> Attorney Paul Wightman represented the Petition and stated that the Conservation <br /> Commission has approved the project, pending ZBA approval. He said that the Shellfish <br /> Constable and the Waterways Commission have been notified of the proposal. Mr. Jim <br /> Hanks of the Waterways Commission attended the meeting and said that the Waterways <br /> Commission has not received anything regarding the above-referenced Petition. <br /> Mr. Brem moved to continue the hearing until July 11, 2001 to allow for approval from <br /> the Waterways Commission. Mr. Guerrera seconded. All agreed. <br /> PUBLIC HEARINGS <br /> Thomas F. & Bonnie A. Smith—Request a Variance from Sections 174-31 and <br /> 174-33 of the Zoning By-laws for permission to vary the front setback requirements, <br /> the setback requirements to water and wetlands and the height requirements to allow <br /> for construction of a single-family home on property located in an R-3 zoning districts <br /> at 266 Monomoscoy Road (Map 120 Block 57B) Mashpee, MA. <br /> Sitting: Edward M. Govoni, Robert G. Nelson and Marshall A. Brem. <br /> Due to delays in obtaining Conservation Commission approval, this proposal was Denied <br /> Without Prejudice by the ZBA in 2000. <br /> Mr. Ed Pesce of Pesce Engineering represented the Petition and stated that the subject <br /> property predates zoning. He said that the actual building height of the home would not <br /> exceed the allowed 35 feet in height; however, proposed construction of a turret would <br /> exceed the allowed maximum by one foot.
