r. <br /> AA <br /> Town o Mash ee <br /> a my <br /> MASHPEE ZONING BOARD OF APPEALS 16 Great Aeck load Xorth <br /> OLE Mashpee, Massachusetts 02649 <br /> Decision for a Special Permit rf <br /> RE: Albino Marusich SP-01-68 376 Monomoscoy Road <br /> Map 125 Block 18 <br /> A Petition was filed on May 15, 2001 by Albino Marusich of Canton, <br /> Massachusetts for a Special Permit under Section 174-25.I.9 of the Zoning By-laws 3; <br /> for permission to construct a pier, ramp and float on Great River on property located <br /> in an R-3 zoning district at 376 Monomoscoy Road(Map 125 Block 18)Mashpee,MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on May 25 and June 1, 2001, <br /> a copy of which is attached hereto and made a part hereof <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, June 13, 2001, at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: Edward M. Govoni, Robert G.Nelson and <br /> Zella E. Elizenberry. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Jeffrey Ryther of BSS Design,Inc. of Falmouth, Massachusetts represented <br /> the Petition and stated that the proposal was drawn after meetings were held with <br /> Conservation Commission Agent Robert Sherman and Harbormaster Perry Ellis. Mr. <br /> Ryther said that the existing old boat slip would be replaced with the new construction. <br /> The Shellfish Constable has approved the proposal contingent upon minor <br /> revisions. The Conservation Commission has approved the project. <br /> Ms. Audrey K.Nickerson, a direct abutter at 374 Monomoscoy Road,reviewed <br /> the plans. Mr. Govoni explained that construction has been designed to avoid the s <br /> shellfish areas. Ms. Nickerson expressed no opposition to the project. No other <br /> comments were received from abutters. <br />
