T.y <br /> Town of Mashee <br /> MASHPEE ZONING BOARD OF APPEALS 16 Great Aeck Poad Aorth <br /> OLE Mashpee, Massachusetts 02649 <br /> Decision for a Variance <br /> RE: Alberto Velella, Trustee V-01-63 407 Monomoscoy Road <br /> Map 124 Block 63 <br /> A Petition was filed on May 8, 2001 by Alberto Velella, Trustee, of Needham, <br /> Massachusetts for a Variance from Section 174-33 of the Zoning By-laws for permission <br /> to vary the setback requirements to water and wetlands to allow for construction of a <br /> single-family home on property located in an R-3 zoning district at 407 Monomoscoy <br /> Road(Map 124 Block 63)Mashpee,NIA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on May 25 and June 1, 2001, <br /> a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, June 13, 2001, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Robert G.Nelson,Richard T. <br /> Guerrera and Zella E. Elizenberry. < "" <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. John Slavinsky of Cape &Islands Engineering represented the Petition and <br /> stated that the Variance granted by the Board regarding the subject property in Decision <br /> V-00-78 on April 26, 2000 has expired. He stated that there are no changes to the <br /> proposed construction of a single-family home on the property. <br /> The Conservation Commission and the Board of Health have approved the <br /> project. <br /> No comments were received from abutters. .; <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 407 Monomoscoy Road and consists of <br /> 41,400 square feet. <br />
