Decision for a Variance RE: Donald B. &Evelyn McIntyre V-01-65 190 Waterway Map 111 Block 95 A Petition was filed on May 8, 2001 by Donald B. and Evelyn McIntyre of Wellesley Hills, Massachusetts for a Variance from Section 174-33 of the Zoning By-laws for permission to vary the setback requirements from water and wetlands to allow for construction of a single-family home with a breezeway and an attached garage on property located in an R-3 zoning district at 190 Waterway(Map 111 Block 95) Mashpee, MA. Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in the Town of Mashpee, on May 25 and June 1, 2001, a copy of which is attached hereto and made a part hereof. A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, June 13, 2001, at which time the following members of the Zoning Board of Appeals were present and acting throughout: Edward M. Govoni, Robert G. Nelson and Zella E. Elizenberry. The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of Mashpee Zoning By-laws. Mr. John Slavinsky of Cape & Islands Engineering represented the Petition LxK and stated that the Variance granted by the Board on the subject property in Decision V-99-106 on December 8, 1999 has expired. He stated that there are no changes to the proposed construction of a single-family home on the property. The Conservation Commission and the Board of Health have approved the project. `'r No comments were received from abutters.
