Kharasch SP-01-70 2 <br /> Board of Appeals <br /> SPECIAL PERMIT CRITERIA <br /> Section 174-20 of the Zoning By-laws. <br /> Rebuilding of destroyed or damaged non-conforming structure. <br /> Any non-conforming building or structure destroyed or damaged by fire, flood <br /> lightning,wind or otherwise may be rebuilt, subject to approval of the Board of <br /> Appeals... <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 11 Pond Street and consists of 14,200 <br /> square feet of land. <br /> SPECIFIC FINDINGS <br /> The Board determined that: <br /> 1. installation of a new septic system would be an improvement to the property. <br /> 2. demolition of the existing dwelling and shed on the subject property would be <br /> an improvement to the property and to the neighborhood. <br /> 3. demolition of the existing dwelling and shed is permissible with grant of a s <br /> Special Permit by the Zoning Board of Appeals. <br /> In view of the foregoing,the Mashpee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the granting of a Special Permit. Upon motion <br /> duly made and seconded,the Zoning Board of Appeals voted unanimously on June 13, <br /> 2001 to grant a Special Permit to allow for demolition of the existing dwelling and shed rK <br /> on the subject property. The Special Permit is conditioned upon compliance with Cape& <br /> Islands Engineering plan entitled: "Proposed Project: Demolish Existing Building, <br /> Construct New Dwelling,Driveway&Utilities,Remove Septic Pump,Relocate Existing <br /> Septic Tank,Proposed Site Plan Located in Mashpee,Mass., Prepared for Sigmund ; $ <br /> Kharasch,Date:Apr. 24, 2001,Rev'd: 5/8/01 and 5/11/01". � ; <br />
