Smith V-01-71 266 Monomoscoy Road <br /> Map 120 Block 57B <br /> A Petition was filed on May 22, 2001 by Thomas F. and Bonnie A. Smith <br /> of Mashpee, Massachusetts for a Variance from Sections 174-31 and 174-33 of <br /> the Zoning By-laws for permission to vary the front setback requirements,the `*T <br /> k`:z <br /> setback requirements to water and wetlands and the height requirements to allow <br /> for construction of a single-family home on property located in an R-3 zoning district <br /> at 266 Monomoscoy Road(Map 120 Block 57B)Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on May 25 and June 1,2001, <br /> a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, June 13, 2001, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Edward M. Govoni, Robert G.Nelson , <br /> and Marshall A. Brem. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> i <br /> Mr. Ed Pesce of Pesce Engineering represented the Petition and stated that the <br /> subject property predates zoning. He said that the actual building height of the home <br /> would not exceed the allowed 35 feet in height;however, construction of a proposed <br /> turret would exceed the allowed maximum by one foot. Mr. Pesce said that the purpose <br /> of the turret is an "architectural aesthetic dressing on the home and to allow ambient light <br /> into the center of the room"and that there is no access to the turret. <br /> The Conservation Commission and the Board of Health have approved the <br /> proposal. <br />
