Mashpee Zoning Minutes—July 25, 2001 7 <br /> Board of Appeals <br /> CONTINUED HEARINGS <br /> The following Petitions have been continued from the February 28, 2001 Public Hearings <br /> to allow the Petitioner to obtain Conservation Commission, Design Review and <br /> Technical Review approval: <br /> Brian D. Casey—Requests a Variance from Section 174-31 of the Zoning By-laws for <br /> ki permission to vary the land space requirements and to combine two lots into one to allow <br /> for a commercial structure with an office and storage space for commercial vehicles and <br /> equipment on properties located in a C-2 zoning district at 8 Sassacus Road and 84 <br /> Algonquin Avenue (Map 72 Blocks 58A and 58B) Mashpee, MA. Owner of record: <br /> Henry C. Labute, Trustee. <br /> Brian D. Casey—Requests a Special Permit under Sections 174-24 and 174-25 of the <br /> Zoning By-laws to allow for a commercial structure with an office and storage space for <br /> commercial vehicles and equipment on properties located in a C-2 zoning district at 8 <br /> Sassacus Road and 84 Algonquin Avenue (Map 72 Blocks 58A and 58B) Mashpee, MA. <br /> Owner of record: Henry C. Labute, Trustee. <br /> Sitting: James E. Regan III, Zella E. Elizenberry and Frederick R. Borgeson. <br /> The ZBA office received a fax dated July 24, 2001 from Mr. Casey requesting a further <br /> continuance/extension of his Petitions. The Board has already granted an earlier request <br /> from Mr. Casey for a continuance/extension of the Petitions. The Petitioner has not yet <br /> received approval from the Conservation Commission, Design Review or Technical <br /> Review. <br /> After much discussion, the Board rendered a decision in order to avoid the possibility of a <br /> constructive grant and to allow the Petitioner an opportunity to receive approval from the <br /> other Town boards before coming back to the ZBA for final approval. <br /> Ms. Elizenberry moved to Deny Without Prejudice the above-referenced Petitions.
