Bynoe of Roxbury, Massachusetts <br /> for a Variance from Section 174-32 of the Zoning By-laws for permission to vary the <br /> f't <br /> f fire protection access requirements to allow for construction of a single-family home on <br /> an unpaved road on property located in an R-3 zoning district at 48 Blue Castle Drive <br /> (Map 104 Parcel 13) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> r Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br />$' a newspaper of general circulation in the Town of Mashpee, on July 6 and July 13, 2001, <br /> a copy of which is attached hereto and made a part hereof. <br /> ' A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> k Wednesday, July 25, 2001, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: James E. Regan III, Richard T. Guerrera <br /> and Zella E. Elizenberry. <br />,r s The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br />`Jtprovisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Edwin A. Monteiro, builder for the project, represented the Petition and stated <br /> that the Zoning Board of Appeals granted a Variance in 1995 on the subject property <br /> allowing for construction of a home on the unpaved road. Mr. Bynoe has owned the <br /> property since 1969 and now wishes to construct a single-family home for his personal <br /> use on the subject property. <br /> No comments were received from abutters. <br /> t' <br /> tt <br />
