Owens SP-01-77 16 Spoondrift Circle <br /> Map 111 Parcel 118 <br /> A Petition was filed on June 25, 2001 by Peter R. and Carolie D. Owens of <br /> Bedford,New Hampshire for a Special Permit under Section 174-17 of the Zoning <br /> By-laws for permission to expand a pre-existing, non-conforming structure to allow <br /> for construction of a garage and an addition to the structure on property located in an <br /> R-3 zoning district at 16 Spoondrift Circle (Map 111 Parcel 118) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on July 6 and July 13, 2001, <br /> a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, July 25, 2001, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Edward M. Govoni, James E. Regan III <br /> and Richard T. Guerrera. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. John Slavinsky of Cape & Islands Engineering represented the Petition <br /> and stated that the subject lot is not in the New Seabury Special Permit area. Mr. <br /> Slavinsky said that the Petitioner is requesting a Special Permit for permission to expand <br /> a pre-existing, non-conforming structure to allow for construction of a garage and an <br /> addition. The proposed construction would be less than 10 feet from the property line <br /> on three sides of the subject property. <br /> The Conservation Commission refuses to allow any construction within the <br /> 50-foot buffer. The Board of Health has approved the proposal. <br /> No comments were received from abutters. <br />
