Kerrigan, Trustee, <br /> Investment Realty Trust of Falmouth, Massachusetts, for a Special Permit under <br /> f Sections 174-25.D.1, 174-25.G.4, 174-25.G.6, 174-25.G.7, 174-25.G.9 and 174-25.H.6 <br /> f; of the Zoning By-laws for permission to construct a warehouse and office to allow for <br /> operation of wholesale business, storage and trucking on property located in I-1 and R-3 <br /> zoning districts at 131 Industrial Drive (Map 88 Block 99) Mashpee, MA. Owner of <br /> record: Paul DeRuyter, Trustee. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> { a newspaper of general circulation in the Town of Mashpee, on July 6 and July 13, 2001, <br /> a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, July 25, 2001, at which time the following members of the Zoning Board <br /> Lof Appeals were present and acting throughout: James E. Regan III, Zella E. Elizenberry <br /> and Frederick R. Borgeson. <br /> J <br /> e <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> 41, Attorney Kevin M. Kirrane represented the Petition and stated that Mr. Kerrigan <br /> has obtained ownership of the subject property. The proposed use is allowed in this <br /> S zoning district upon the grant of a Special Permit from the Zoning Board of Appeals. The <br /> subject property conforms to lot size, frontage and setback requirements. <br /> Attorney Kirrane reminded the Board that on March 28, 2001 it granted a Special <br /> rl Permit to Mr: Gary Tavares allowing for operation of a landscaping business on the other <br />` half of the subject property. <br />�s <br /> t � <br /> Attorney Kirrane submitted a detailed outline of the proposal and said that the <br /> s' Petitioner proposes to operate his business of excavation contracting and waste disposal <br /> ' system installation from the subject property. The proposed building will consist of two <br /> E4 units. The Petitioner proposes to house his business in one of the units and lease the <br /> other unit. Office space and limited storage of materials used in connection with the <br /> business will be stored inside the proposed building. Some outside storage along with <br /> parking of vehicles and trailers will be located to the rear of the building. <br />
