Dale� Y � Y P Y of <br /> F4 Mashpee, Massachusetts for a Variance from Section 174-31 of the Zoning By-laws for <br /> permission to vary the side and front setback requirements to allow for construction of a <br /> A <br /> deck to an existing home on property located in an R-3 zoning district at 219 Waterway <br /> (Map 111 Block 74) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on July 6 and July 13, 2001, <br /> a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, July 25, 2001, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: James E. Regan III, Zella E. Elizenberry <br /> and Marshall A. Brem. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br />..; provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> r <br /> Mashpee Zoning By-laws. <br /> Mr. Daley represented his Petition and stated that the Variance granted by the <br /> Zoning Board of Appeals on June 14, 2000 has lapsed. Mr. Daley said that he has been <br /> unable to contract a builder to start construction. <br /> The proposal calls for the existing deck on the subject lot to be rebuilt and <br /> V <br /> expanded. The subject lot is surrounded by streets on three sides and requires relief from <br /> the setback requirements in order to enhance the size of the existing deck. <br /> No comments were received from abutters. <br /> i± <br /> r' <br /> F#S; <br />
