Mashpee Zoning Minutes—August 22, 2001 8 <br /> Board of Appeals <br /> f quality, will not have a significant adverse impact on wildlife habitat, estuarine systems, <br /> traffic flow, traffic safety, waterways, fisheries, public lands or neighboring properties, <br /> will not cause excessive levels of noise, vibrations, electrical disturbance, radioactivity or <br /> `n glare, will not destroy or disrupt any species listed as rare, endangered or threatened by <br /> the Massachusetts Natural Heritage Program or any known historic or archaeologic site, <br /> will not produce amounts of trash, refuse or debris in excess of the town's landfill and <br /> waste disposal capacities, will properly dispose of stumps, construction debris, hazardous <br /> materials and other waste, will provide adequate off-street parking, will not cause <br /> Y <br /> excessive erosion or cause increased runoff onto neighboring properties or into any <br /> natural river, stream, pond or water body'and will not otherwise be detrimental to the <br /> town or the area. <br /> § 174-25.E.7 Principle retail business and consumer service establishments. <br /> s Veterinary establishment, kennel or similar establishment, provided that in a business <br /> zone, animals are kept wholly indoors". <br /> The project has been designed according to the requirements of the Groundwater <br /> Protection District. Because the bodies of any dead animals will be disposed of outside <br /> F S. <br /> the Town of Mashpee by a special contractor, the proposal will not involve the use of <br /> hazardous waste. <br /> § 174-82.A Special permit uses; application procedure. <br /> Within the Groundwater Protection District. unless prohibited by a specific provision of <br /> Article VI, the following uses may be permitted by the Planning Board under any special <br /> permit issued by that Board, or otherwise by a special permit from the Zoning Board of <br /> �v Appeals following the procedures specified in Subsection B. below, under such <br /> now <br /> conditions as each Board, acting as the permitting authority, may require. <br /> "§ 174-82.B Any application for a special permit shall be made, reviewed and acted upon <br /> in accordance with the following procedures: <br /> g <br /> Y (1) Each application for a special permit shall be filed, in writing, with the <br /> ' s Board of Appeals and shall contain a complete description of the proposed <br /> use, together with any supporting information and plans which the Board <br /> of Appeals may require. <br /> (2) The Board of Appeals shall refer copies of the application to the Board of <br /> Health, Planning Board, Conservation Commission and Town Engineer or <br /> Department of Public Works, which shall review, either jointly or <br /> separately, the application and shall submit their recommendations to the <br /> Board of Appeals. Failure to make recommendations within thirty-five <br /> (35) days of the referral of the application shall be deemed lack of <br /> opposition. <br /> (3) The Board of Appeals shall hold a public hearing on the application, in <br /> conformity with the provisions of Massachusetts General Laws, Chapter <br /> f 4 40A, within sixty-five (65) days after the filing of the application with the <br /> Board of Appeals. <br /> 4'yi,y`F <br /> iF�y <br />
