East, Jr. of <br /> Sudbury, Massachusetts for a Variance from Section 174-31 of the Zoning By-laws for <br /> permission to vary the lot coverage and setback requirements to allow for construction <br /> of a raised patio to an existing dwelling on property located in an R-3 zoning district at <br /> 22 Wilson's Grove (Map 118 Parcel 75) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on August 24 and August <br /> 31, 2001, a copy of which is attached hereto and made a part hereof. <br /> The September 12, 2001 Public Hearings were canceled due to the national <br /> tragedy that occurred on September 11, 2001. A Public Hearing was held on the Petition <br /> at the Mashpee Town Hall on Wednesday, September 19, 2001, at which time the <br /> following members of the Zoning Board of Appeals were present and acting throughout: <br /> Edward M. Govoni, Robert G. Nelson and Richard T. Guerrera. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> I <br /> Mr. East represented his Petition and stated that he is looking for Variance relief <br /> to allow for the raised patio that has already been constructed on the property. He <br /> i <br /> submitted photos of the subject property and said that it was graded and a retaining wall <br /> li <br /> was installed to prevent run-off onto the abutting lot. Mr. East said that the grade of the 'I <br /> lot was changed due to the Title V requirements regarding the water table. <br /> I <br /> Mr. East said that his family has owned the property since the 1940's, that it has <br /> i <br /> been in separate ownership and that the family has not owned any abutting properties. <br /> I <br /> i <br /> ''r <br />
