East, Jr. V-01-86 2 <br /> Board of Appeals <br /> Patricia Senville and Doug Farley, abutters at 20 Wilson's Grove, said that they <br /> have been experiencing water problems in their basement over the past several months <br /> I I <br /> Ms. Senville stated that equipment from the Petitioner's construction site at 22 Wilson's <br /> Grove was driven over her property. Mr. Farley agreed and claimed that the leaching <br /> �I <br /> field has been damaged due to the trucks driving over the property and that the change in <br /> ' i <br /> the grade of the Petitioner's property has produced water problems on their abutting lot. <br /> Mr. East said that he paid to have the abutters' foundation tarred, to have the level <br /> of their yard raised and for sod to be installed on their property. He said that the licensed <br /> septic system installer who performed the work guaranteed that if the abutter developed <br /> Title V problems and the problems were traced back to his work, that he would correct <br /> the situation. <br /> Mr. Govoni said that the agreement sounded fair to all concerned. He suggested <br /> that the abutters hire an expert to inspect the septic system and determine the cause of the <br /> water problem in their basement. Mr. Govoni said that the abutters should also contact <br /> the Board of Health concerning their situation. <br /> No other comments were received from abutters. <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 22 Wilson's Grove and consists of 2,250 <br /> square feet of land. <br /> SPECIFIC FINDINGS <br /> 1. the Board determined that the subject property has been in single ownership <br /> since before 1959, that it predates adoption of zoning and that zoning is not an <br /> issue. <br /> I! JII <br /> Upon motion duly made and seconded the Zoning Board of Appeals voted <br /> unanimously on September 19, 2001 to overturn the Building Commissioner's decision <br /> and found that the Petitioner does not require Variance relief to allow for construction of <br /> the <br /> patio. The Board demandsdocumentation <br /> that the Petitioner shallrovide <br /> p to the ' <br /> Building Commissioner that the subject property at 22 Wilson's Grove has been in single <br /> ownership and that it predates adoption of zoning by the Town of Mashpee. <br /> i <br /> I <br />
