TOWN OF MASHPEE <br /> Minutes—Zoning Board of Appeals <br /> Wednesday, September 19, 2001 <br /> The Mashpee <br /> Zoning Board of <br /> Appeals canceled the September 12, 2001 Public <br /> Hearings due to the National Tragedy that occurred on September 11, 2001. The Board <br /> held Public Hearings on September 19, 2001 at 7:30 P.M. at the Mashpee Town Hall. <br /> Board Members present were Chairman Edward M. Govoni, Clerk Robert G. Nelson <br /> and Associate Members Richard T. Guerrera, Zella E. Elizenberry and Frederick R. <br /> Borgeson. Vice Chairman James E. Regan III and Associate Member Marshall A. Brem <br /> were not present. <br /> i <br /> PUBLIC HEARINGS <br /> George H. & Marie A. East, Jr. —Request a Variance from Section 174-31 of the Zoning <br /> By-laws for permission to vary the lot coverage and setback requirements s to allow for <br /> construction of a raised patio to an existing dwelling on property located in an R-3 zoning <br /> district at 22 Wilson's Grove (Map 118 Parcel 75) Mashpee, MA. <br /> Sitting: Edward M. Govoni, Robert G. Nelson and Richard T. Guerrera. <br /> Mr. East represented his Petition and stated that he is looking for Variance relief to allow <br /> for the raised patio that has already been constructed on the property. He said that <br /> he was I I <br /> originally told t <br /> hat the patio did not have to I <br /> g Y p be included m calculating the lot coverage. � <br /> Mr. East submitted photos of the subject property and said that the property was graded <br /> and a retaining wall was installed to prevent run-off onto a neighboring lot. Mr. East said <br /> that his family has owned the property since the 1940' <br /> s that it has been in separate <br /> ownership and that the family has not owned any abutting properties. <br /> Mr. Bore « <br /> son said that he visited sited the site and that the proposal "coincides with the rest of I'I <br /> p p <br /> the area" and homes in the neighborhood. <br /> Mr. Govoni said that because this lot was created before 1959 neither current setback nor <br /> lot coverage requirements apply. Mr. Govoni suggested that a letter should be sent to the <br /> Building Commissioner from the ZBA to that stating same. <br /> Patricia Senville, Cynthia Mandeville and Doug Farley, abutters at 20 Wilson's Grove, <br /> expressed concern with serious water problems in their basement over the past several <br /> months. <br /> Mr. East said that his property used to be the low point and that was why it was re- <br /> graded. <br /> Ms. Senville said that they hadn't experienced water problems or septic problems until <br /> recently. She stated that she has pictures proving that equipment (from the Petitioner's <br /> construction site at 22 Wilson's Grove) was driven over her property and indicated that <br /> I <br /> i <br />
