E ZONING BOARD OF APPEALSII <br /> 16 Great J�eck load J�orth <br /> �^ Mashpee, Massachusetts 02649 <br /> �stauil <br /> Decision for a Special Permit <br /> RE: James Mitchell, Trustee SP-01-106 43 Shoestring Bay Road <br /> Popponesset Bay Realty Trust Map 84 Parcel 26 !% <br /> ! <br /> A Petition was filed on September 24, 2001 by James Mitchell, Trustee, <br /> Popponesset Bay Realty Trust of Melrose, Massachusetts, for a Special Permit under <br /> Section 174-25.I.9 of the Zoning By-laws to allow for construction of a pier, ramp and <br /> float on Popponesset Bay on property located in an R-3 zoning district at 43 Shoestring <br /> '� II <br /> Bay Road (Map 84 Parcel 26) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on October 5 and October <br /> 12, 2001, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, October 24, 2001. The Petition was continued to allow the Petitioner an <br /> opportunity to receive Conservation Commission approval. At the continued hearings <br /> II <br /> held on December 12, 2001, the following members of the Zoning Board of Appeals <br /> were present and acting throughout: Robert G. Nelson, Frederick R. Borgeson and <br /> Marshall A. Brem. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> i <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. . <br /> Ms. Eliza Cox of Nutter, McClennen& Fish, LLP represented the Petitioner and <br /> stated that construction of the proposed pier, ramp and float on the subject property will <br /> not exceed the 70-foot total length limit. Plans call for removal of the existing ramp, <br /> which will be replaced with new plantings. Ms. Cox said that the proposal will be a <br /> shared facility with one of the abutters. A single-family house is currently under <br /> construction on the subject property. <br /> The Conservation Commission has approved the plan and issued an Order of <br /> Conditions. The Shellfish Constable has also approved the proposal. <br />
