Mashpee Zoning Minutes—October 10, 2001 g <br /> Board of Appeals <br /> said that the Petitioner could pull one permit this year, one permit next year and also <br /> develop the lot with the building next year. <br /> Attorney Kirrane said that he understands the Boards argument. He said that the By-law <br /> does not make sense because it penalizes small developers. He said that the Petitioner <br /> does not have less rights than other property owners merely because he sits on a local <br /> Board. Ms. Elizenberry replied, "We are not trying to penalize our chairperson. <br /> Understand that very clearly". She expressed the same concerns as the other Board j <br /> members and said that " we feel you have a legitimate chance of getting building permits <br /> that will remove any hardships which you might incur and we want to recommend that <br /> you take that risk and not ask us to incur it for you". <br /> Mr. Nelson stated that the Petitioner has not "exhausted all avenues of appeal". Mr. <br /> Brem asked how many building permits remain for the year. Mr. Wheeler indicated that ! <br /> approximately 35 building permits remain. j ( I <br /> No comments were received from abutters. <br /> Attorney Kirrane said that he would have to confer with his client to consider the Board's <br /> comments. Mr. Brem said that if the Petitioner faced a hardship within the next year, <br /> then the Board would handle the request accordingly. <br /> Mr. Nelson moved to continue the Petitions until October 24, 2001. Mr. Borgeson <br /> seconded. All agreed. <br /> �I <br /> MINUTES <br /> Accept Minutes of September 19, 2001. <br /> Mr. Nelson moved to revise sentence on East Petition from "to grant a Variance" to I! <br /> "overturn the Building Commissioner's decision and found that the Petitioner does not <br /> require Variance relief to allow for construction of the patio".
