Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in the Town of Mashpee, on September 21 and September 28, 2001, a copy of which is attached hereto and made a part hereof. 1 The Board received a letter dated October 10, 2001 from Mr. Robert A. Silva, builder for the project, requesting a continuance of the above-referenced Petition. The Board voted unanimously to continue the Petition until November 14, 2001. At the continued Public Hearings held on the Petition at the Mashpee Town Hall on Wednesday, October 10, 2001, the following members of the Zoning Board of Appeals were present and acting throughout: James E. Regan III, Robert G. Nelson and Richard T. Guerrera. The Mashpee Zoning Board of Appeals issues this Decision pursuant to the ! j provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of Mashpee Zoning By-laws. The Petitioner has not yet filed with the Conservation Commission for approval of the proposal. The Petitioner did not attend the Public Hearings. In view of the foregoing and upon motion duly made and seconded, the Zoning Board of Appeals voted unanimously on November 14 2001 to Deny Without Prejudice the above-referenced Petition for a Special Permit, SP-01-98.
