Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on September 21 and <br /> September 28, 2001, a copy of which is attached hereto and made a part hereof. 1 <br /> The Board received a letter dated October 10, 2001 from Mr. Robert A. Silva, <br /> builder for the project, requesting a continuance of the above-referenced Petition. The <br /> Board voted unanimously to continue the Petition until November 14, 2001. <br /> At the continued Public Hearings held on the Petition at the Mashpee Town Hall <br /> on Wednesday, October 10, 2001, the following members of the Zoning Board of <br /> Appeals were present and acting throughout: James E. Regan III, Robert G. Nelson and <br /> Richard T. Guerrera. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the ! j <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> The Petitioner has not yet filed with the Conservation Commission for approval of <br /> the proposal. The Petitioner did not attend the Public Hearings. In view of the foregoing <br /> and upon motion duly made and seconded, the Zoning Board of Appeals voted <br /> unanimously on November 14 2001 to Deny Without Prejudice the above-referenced <br /> Petition for a Special Permit, SP-01-98. <br /> I I � <br />
