Mashpee Zoning Dominic Tiberio V-01-101 2 <br /> Board of Appeals <br /> SPECIAL PERMIT CRITERIA <br /> Section 174-25.1.9 states that the Board must find that the structure will not <br /> unduly interfere with the free passage of travel by water or land or cause or contribute <br /> to the substantial disruption or degradation of the marine or coastal environment. <br /> GENERAL FINDINGS '', <br /> 1. that the subject property is located at 15 Ockway Bay Road and contains 1.26 <br /> acres of land fronting on Ockway Bay. <br /> �i <br /> SPECIFIC FINDINGS I <br /> The Board determined that: <br /> ll' <br /> 1. the proposed dock will be an accessory to an existing dwelling and is a <br /> permissible use upon the grant of a Special Permit. I! <br /> 2. the Petitioner met the criteria and the Board has granted a Special Permit to <br /> allow for construction of a pier, ramp and float. <br /> 3. the proposal has been reviewed by the Conservation Commission to address <br /> impacts on the coastal environment. it <br /> I I! <br /> 4. the use is in harmony with the general purpose and intent of the By-laws. <br /> 5. the owner has rights to maintenance in perpetuity. <br /> 6. filing with the Corps of Engineers shall be considered execution of the Special <br /> Permit. <br /> In view of the foregoing,the Mashpee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the granting of a Variance. Upon motion duly <br /> made and seconded, the Zoning Board of Appeals voted unanimously on October 10, <br /> 2001 to grant a Variance of 42 feet to allow for construction of the pier, ramp and float <br /> on the subject property. The Variance is conditioned upon compliance with plan entitled <br /> "Site Plan Prepared for Dominic Tiberio, Lots 20 & 21, Ockway Bay Road, Mashpee, <br /> I <br /> MA.,Date: 05/18/00, Rev. 05/25/01, 08/22/01, J.E.
