Owens V-01-96 16 Spoondrift Circle <br /> Map 111 Parcel 118 <br /> A Petition was filed on August 24, 2001 by Peter R. and Carolie D. Owens of <br /> Bedford,New Hampshire for a Variance from Sections 174-31 and 174-33 of the Zoning <br /> By-laws for permission to vary the side, front and lot coverage requirements and the <br /> setback requirements to water and wetlands to allow for construction of a garage and an <br /> addition to a pre-existing, non-conforming structure on property located in an R-3 zoning <br /> district at 16 Spoondrift Circle (Map 111 Block 118) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on September 21 and <br /> September 28, 2001, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, October 10, 2001, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Edward M. Govoni, James E. Regan III <br /> and Robert G.Nelson. �I <br /> I <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> p I <br /> Mashpee Zoning By-laws. <br /> Mr. John Slavinsky of Cape & Islands Engineering represented the Petition and <br /> reminded the Board of the original proposal of that the Petitioner withdrew in August <br /> 2001. At the August Public Hearings, the Board requested that the Petitioner advise the <br /> abutting neighbor at 18 Spoondrift Circle of the proposed construction. Mr. Slavinsky <br /> submitted a letter from the abutting neighbors, Mr. and Mrs. Brick at 18 Spoondrift <br /> Circle, in approval of the proposal. No other comments were received from abutters. <br /> The Board of Health and the Conservation Commission have approved the <br /> project. <br /> Mr. Owens addressed the Board and submitted a letter explaining the nature of the <br /> neighbors. <br /> proposal. Mr. Owens said that he has consulted with each of the immediate neigh III <br /> The neighbors have expressed approval with the proposed renovation of the home since it <br /> would be an improvement to the entire neighborhood. <br /> Mrs. Owens submitted photos of the existing home and stated that plans call for j <br /> additions to the sides of the house.
