Owens V-01-96 16 Spoondrift Circle Map 111 Parcel 118 A Petition was filed on August 24, 2001 by Peter R. and Carolie D. Owens of Bedford,New Hampshire for a Variance from Sections 174-31 and 174-33 of the Zoning By-laws for permission to vary the side, front and lot coverage requirements and the setback requirements to water and wetlands to allow for construction of a garage and an addition to a pre-existing, non-conforming structure on property located in an R-3 zoning district at 16 Spoondrift Circle (Map 111 Block 118) Mashpee, MA. Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in the Town of Mashpee, on September 21 and September 28, 2001, a copy of which is attached hereto and made a part hereof. A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, October 10, 2001, at which time the following members of the Zoning Board of Appeals were present and acting throughout: Edward M. Govoni, James E. Regan III and Robert G.Nelson. �I I The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of p I Mashpee Zoning By-laws. Mr. John Slavinsky of Cape & Islands Engineering represented the Petition and reminded the Board of the original proposal of that the Petitioner withdrew in August 2001. At the August Public Hearings, the Board requested that the Petitioner advise the abutting neighbor at 18 Spoondrift Circle of the proposed construction. Mr. Slavinsky submitted a letter from the abutting neighbors, Mr. and Mrs. Brick at 18 Spoondrift Circle, in approval of the proposal. No other comments were received from abutters. The Board of Health and the Conservation Commission have approved the project. Mr. Owens addressed the Board and submitted a letter explaining the nature of the neighbors. proposal. Mrs. Owens submitted photos of the existing home and stated that plans call for j additions to the sides of the house. She said that the addition would consist of a bedroom j and a bath. f �I
