Town qfMashpee <br /> BOARD OF APPEALS 16 Great Aeck �kpad Aorth <br /> Decision for a Special Permit Mashpee, Massachusetts 02649 <br /> RE: Paul G. & Marlene Bucuvalas SP-99-6 Map 117 Block 136 <br /> 16 Elliot Road <br /> A Petition was filed on November 20, 1998 by Paul G. and Marlene Bucuvalas of <br /> Mashpee, Massachusetts for a modification to the existing Special Permit (SP-90-57) <br /> under Section 174-17 of the Zoning By-laws for permission to remove an existing deck <br /> and replace it with a farmer's porch on property located in an R-3 zoning district at <br /> 16 Elliot Road (Map 117 Block 136), Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on December 22 and <br /> December 29, 1998, a copy of which is attached hereto and made a part hereof <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, January 13, 1999, at 7:30 P.M., at which time the following members of the <br /> Board of Appeals were present and acting throughout: Edward M. Govoni, James M. <br /> Dorgan and Robert G. Nelson. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Attorney Kevin Kirrane, the builder, Mr. Carl MacDonald, and Mr. and Mrs. <br /> Bucuvalas attended the meeting, <br /> Attorney Kirrane represented the applicants and stated that the original design of <br /> the home has decks that protrude from the house, In 1990, the Board of Appeals granted <br /> a Special Permit that included the decks. One deck is 8.9 feet from Elliot Road, another <br /> deck is 12.7 feet from Elliot Road and the third deck is within 18 feet of Elliot Road. The <br /> applicants propose to remove two decks and add a farmer's porch in the front of the <br /> dwelling. The remaining deck on the second floor will serve as a balcony, He stated that <br /> the home will remain a two-story, single-family dwelling. <br /> No comments were received from abutters. <br />
