West SP-99-1 26 Russell Road <br /> Map 120 Block 29 <br /> A Petition was filed on November 2, 1998 by John L. and Cynthia J. West of <br /> Hebron, Connecticut for a Special Permit under Section 174-25.1.9 of the Zoning <br /> By-laws for the construction of a pier, ramp and float on Little River on property located <br /> in an R-3 zoning district at 26 Russell Road(Map 120 Block 29), Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on December 22 and <br /> December 29, 1998, a copy of which is attached hereto and made a part hereof <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, January 13, 1999, at 7:30 P.M., at which time the following members of the <br /> Board of Appeals were present and acting throughout: Edward M. Govoni, James M. <br /> Dorgan and Richard T. Guerrera. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mi. Govoni read a letter from Cape & Islands Engineering requesting that the <br /> application be continued to allow the applicant to submit signed engineering plans of the <br /> pier, ramp and float. The Board moved to continue the hearing until March 10, 1999. <br /> At the continued hearing on March 10, 1999, Mr. Govoni read a letter from <br /> Harbormaster Perry Ellis requesting that Mr. West reduce the size of the float from 8 x 16 <br /> feet to 6 x 16 feet and reduce the length of the ramp from 20 feet to 18 feet. <br /> MT. West represented his application and stated that the Conservation <br /> Commission has approved his plans. He also stated that he would have over 100 feet <br /> of water between his side and any structure on the other side of Little River. <br /> Mr. Dorgan stated that Mr. West needs a plan stamped by a professional engineer <br /> on a Title dock, especially since there have been substantial changes made to the plan. <br /> The Board moved to continue the hearing until April 14, 1999 to enable the applicant to <br /> have the plans revised and signed by a professional engineer. <br /> At the continued Hearing on April 14, 1999, Mr. West represented his application <br /> and submitted new plans signed by a professional engineer. Mr. West requests <br /> permission to finish the reconstruction of his dock in the same footprint as the old one. <br />
