,,,I OWN <br /> Town ofMashpee <br /> 16 Great Xeck q�pad dVorth <br /> BOARD OF APPEALS Mashpee, Massachusetts 02649 <br /> Decision for a Variance <br /> RE: Zelda Pernstein V-99-13 161 Daniels Island Road <br /> Map 105 Block 271 <br /> A Petition was filed on January 6, 1999 by Zelda Pernstein for a Variance <br /> from Section 174-31 of the Zoning By-laws for permission to vary the front setback <br /> requirements and lot coverage on property located in an R-3 Zoning district at 161 <br /> Daniels Island Road (Map 105 Block 271), Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on January 22 and January 29, <br /> 1999, a copy of which is attached hereto and made a part hereof <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, February 10, 1999, at which time the following members of the Board of <br /> Appeals were present and acting throughout: Edward M. Govoni, James E. Regan III and <br /> Richard T. Guerrera. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Thomas P. Damelio represented the applicant and stated that the owner plans <br /> on spending more time on the Cape and desires to expand the existing structure. <br /> Mr. Govoni stated that the Conservation Commission permit expired in <br /> November of 1998. After talking with Mr. Robert Sherman from the Conservation <br /> Commission, Mr. Govoni informed Mr. Damelio that the applicant needs to apply for a <br /> simple RDA (Request for Determination of Applicability) from the Conservation <br /> Commission. <br /> No comments were received from abutters. <br />
