Partnership SP-99-14 38 Nathan Ellis Highway <br /> Map 74 Block 20 <br /> A Petition was filed on January 11, 1999 by Mashpee Commons Limited <br /> Partnership for a minor revision of an existing Special Permit(SP-86-04-024) for <br /> permission to relocate building space square footage, parking areas and residential <br /> units on property located in a C-1 zoning district at 38 Nathan Ellis Highway <br /> (Map 74 Block 20), Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on January 22 and January 29, <br /> 1999, a copy of which is attached hereto and made a part hereof <br /> A Public Hearing was held on the Petition at the Mashpec Town Hall on <br /> Wednesday, February 10, 1999, at which time the following members of the Board of <br /> Appeals were present and acting throughout: Edward M. Govoni, James E. Regan III and <br /> Richard T. Guerrera. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Regan stated that he is a tenant of Mashpee Commons. Since only three <br /> Board Members were in attendance, Mr. Govoni questioned if anyone was opposed to <br /> Mr. Regan sitting in on the hearing. No one raised an objection. Mr. Regan then stated <br /> that he is acting as a special municipal employee at tonight's Public Hearings. <br /> Douglas S. Storrs, Vice President, Mashpee Commons, represented the applicant <br /> and stated that the proposal is a minor revision of Special Permit, SP-86-04-024, granted <br /> in 1986 by the Board of Appeals. Mi. Storrs stated that the 1986 plan needs to be updated <br /> in order to benefit Mashpee Commons and the public. He also stated that the proposal is <br /> to reallocate square footage that meets the plan's goals and reflects the lessons learned in <br /> the last 13 to 14 years but does not, by its alteration, increase the Special Permit. <br /> Mr. Storrs submitted an updated table documenting buildings by number, square <br /> footage and residential units assigned to each building and a map of Mashpee Commons <br /> documenting the reallocation of some of the square footage, copies of which are attached <br /> and made part hereof the Special Permit He stated that what they are doing is taking the <br /> same square footage and reorganizing it.
