Sullivan V-99-16 416 Monomoscoy Road <br /> Map 124 Block 47 <br /> A Petition was filed on January 20, 1999 by Bartley & Martha M. Sullivan of <br /> Braintree, Massachusetts for a Variance from Section 174-31 of the Zoning By-laws for <br /> permission to vary the lot size and frontage requirements on properties located in an R-3 <br /> zoning district at 416 Monomoscoy Road (Map 124 Block 47) and 422 Monomoscoy <br /> Road (Map 124 Block 48), Mashpee, MA. (Owner of record of 422 Monomoscoy Road: <br /> James B. & Margaret Reiffarth). <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on February 5 and February <br /> 12, 1999, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, February 24, 1999, at 7:30 P.M. at which time the following members of the <br /> Board of Appeals were present and acting throughout: Edward M. Govoni, James E. <br /> Regan III and Richard T. Guerrera. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Attorney Leslie-Ann Morse represented the applicants and stated that they wish to <br /> convey a ten-foot strip of land to their abutting neighbors,the Reiffarths. Attorney <br /> Morse submitted an enlarged copy of the plan and a copy of the 1947 Land Court <br /> subdivision plan. Mr. Govoni inquired if the applicants had gone to the Planning Board <br /> to change the lot sizes. Attorney Morse said that after discussion with Town Counsel, <br /> the Town Planner told the applicants to request a Variance from the Board of Appeals <br /> because they are reducing the frontage and lot size of the Sullivan's non-conforming lot. <br />
