Lerman V-99-22 141 Shields Lane <br />Map 30 Block 24 <br />A Petition was filed on February 4, 1999 by Sidney & Marilyn F. Lerman of <br />Mashpee, Massachusetts for a Variance from Section 174-32 of the Zoning By-laws <br />for permission to construct a single-family dwelling on an unpaved road on property <br />located in an R-5 zoning district at 141 Shields Lane (Map 30 Block 24), Mashpee, MA. <br />Notice was duly given to abutters in accordance with Massachusetts General <br />Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br />newspaper of general circulation in the Town of Mashpee, on February 19 and <br />February 26, 1999, a copy of which is attached hereto and made a part hereof. <br />A Public Hearing was held on the Petition at the Mashpee Town Hall on <br />Wednesday, March 10, 1999, at which time the following members of the Board of <br />Appeals were present and acting throughout: Edward M. Govoni, James M. Dorgan <br />and Richard T. Guerrera. <br />This Decision is issued by the Mashpee Board of Appeals pursuant to the <br />provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br />Mashpee Zoning By-laws. <br />Mr. Michael DeDecko represented the applicants and submitted a more detailed <br />plan showing the exact location of fire hydrants in the area and their proximity to the <br />property. He also submitted a plan of the proposed denitrification septic system that will <br />be installed. <br />Mr. Govoni confirmed with Mr. DeDecko that there are existing homes in the <br />immediate neighborhood. Mr. DeDecko also stated that Shields Lane is processed <br />asphalt. Mr. Govoni acknowledged that it is an approved dirt road. <br />Mr. Brad Caffyn requested to review the plans, stating that he "has a similar case <br />coming up". No comments were received from abutters. <br />
