Town of Mashpee <br />BOARD OF APPEALS <br />Decision for a Special Permit <br />RE: James R. & Anne L. Collins SP -99-21 <br />16 Great JVeck qtoad Aorth <br />Mashpee, Massachusetts 02649 <br />6 Rock Island Road <br />Map 123 Block 21 <br />A Petition was filed on January 28, 1999 by James R. & Anne L. Collins <br />of Walpole, Massachusetts for a Special Permit under Section 174-20 of the <br />Zoning By-laws for permission to demolish an existing house and construct a new <br />three-bedroom home on property located in an R-3 zoning district at 6 Rock Island <br />Road (Map 123 Block 21), Mashpee, MA. <br />Notice was duly given to abutters in accordance with Massachusetts General <br />Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br />a newspaper of general circulation in the Town of Mashpee, on February 19 and <br />February 26, 1999, a copy of which is attached hereto and made a part hereof. <br />A Public Hearing was held on the Petition at the Mashpee Town Hall on <br />Wednesday, March 10, at which time the following members of the Board of Appeals <br />were present and acting throughout: Edward M. Govoni, James E. Regan III and James <br />M. Dorgan. <br />This Decision is issued by the Mashpee Board of Appeals pursuant to the <br />provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of <br />Mashpee Zoning By-laws. <br />Mr. John Slavinsky of Cape & Islands Engineering represented the applicants, <br />Mr. and Mrs. Collins, who also attended the meeting. Mr. Slavinsky submitted new plans <br />and stated that the sideline setback will be changed to 8 feet, rather than 10 feet, due to <br />the placement of the chimney on the other side of the house. He also submitted photos of <br />the 1950's style cottage that will be demolished. <br />Mr. Slavinsky stated that the property has an existing cesspool that will be <br />replaced with the installation of a new Title V septic system. The Board of Health has <br />granted the applicants a Variance of six feet on the placement of the new septic system. <br />Mr. Slavinsky said that there is a designated reserve area as required by the Conservation <br />Commission. <br />
