Board of Appeals Cape Cod Ventures, Inc. — Jiffy Lube SP -99-28 <br />Specific Findings <br />1. that the changes between the proposed construction and the prior one will <br />result in lot coverage of only 6%. <br />2. that there is adequate land area to provide sufficient room for the 14 parking <br />spaces. <br />3. that the applicant will install a state -approved curb cut. <br />4. that section 174-25.H.6. be removed from the application. <br />5. that the applicant must conform to the conditions of the Design Review <br />Committee. <br />6. that the signs will be reduced to 20 square feet, 4 feet off the ground, <br />surrounded by landscaping. <br />7. that the building colors will be Cape Cod gray, black roof, white trim. <br />8. that any change made to the plan will require approval from the Board of <br />Appeals. <br />9. that the applicant will submit a new updated, signed plan. <br />10. that the applicant will post a $20,000 landscaping and performance security. <br />11. that the proposal will not create an adverse impact on public safety or welfare. <br />12. that the building has been designed to avoid creating excessive demands on <br />community services. <br />13. that the proposal is compatible with the other uses in the area and a welcome <br />addition to the business community of the Town of Mashpee. <br />14. that the location is suitable for the proposed use. <br />15. that taxes will be paid in their entirety on the subject property before issuance <br />of any building permits. <br />In view of the foregoing, the Mashpee Board of Appeals found that the applicant met <br />the criteria necessary for the granting of a Special Permit. Upon motion duly made and <br />seconded, the Board of Appeals voted unanimously on April 14, 1999 to grant a Special <br />Permit. The permit is conditioned upon compliance of plan entitled "Proposed Site <br />Development, 60 Falmouth Road (Route 28), Mashpee, Massachusetts, Proposed Jiffy <br />Lube Facility, FOR: Cape Cod Ventures, Inc., 1209 Pitchers Way, Hyannis, MA 02601, <br />By: Rand Associates Consulting, Inc., 495 Upham Street, Melrose, MA 02176".
