Town of Mashpee <br />BOARD OF APPEALS 16 Great ,Neck load Xorth <br />Mashpee, Massachusetts 02649 <br />Decision for a Variance <br />RE: John C. & Joann T. Wojciechowicz V-99-25 67 Great Pines Drive <br />Map 88 Block 5 <br />A Petition was filed on March 8, 1999 by John C. & Joann T. Wojciechowicz of <br />Mashpee, Massachusetts for a Variance from Section 174-31 of the Zoning By-laws for <br />permission to vary the sideline setback requirements on an existing shed and to allow for <br />an addition to a non -conforming dwelling on property located in an R-3 zoning district at <br />67 Great Pines Drive (Map 88 Block 5) Mashpee, MA. <br />Notice was duly given to abutters in accordance with Massachusetts General <br />Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br />newspaper of general circulation in the Town of Mashpee, on March 26 and April 2, <br />1999, a copy of which is attached hereto and made a part hereof. <br />At the Public Hearing on April 14, 1999, Mr. and Mrs. Wojciechowicz requested <br />that the Board continue their application to allow them time to resolve issues concerning <br />their application for a Special Permit with their homeowner's association. <br />A Public Hearing was held on the Petition at the Mashpee Town Hall on <br />Wednesday, June 9, 1999, at which time the following members of the Board of Appeals <br />were present and acting throughout: James E. Regan 11I, Richard T. Guerrera and Robert <br />G. Nelson. <br />This Decision is issued by the Mashpee Board of Appeals pursuant to the <br />provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br />Mashpee Zoning By-laws. <br />Mr. and Mrs. Wojciechowicz represented their application and stated that the <br />addition will provide much needed living space in order to accommodate large family <br />gatherings. They also requested a Variance to allow the existing shed to remain as shown <br />on the plot plan. <br />Mr. and Mrs. Bodzioch, the abutters on whose side the addition will encroach, <br />sent a letter to the Board prior to the April 14, 1999 meeting stating that they have no <br />objection to the proposal. <br />Mr. Wojciechowicz submitted plans from Cape & Islands Engineering and stated <br />that they propose to replace the existing septic system with a new Title V Septic System. <br />Mr. Regan read letters from abutters, Thomas Davies and James A. Young, along <br />with a petition signed by 20 members of the Greenwood Homeowner's Association, <br />expressing approval of the proposed addition. <br />
